Introduction

We are pleased that you are interested in our products. We at uptain GmbH (“uptain”, “we”, “us” and their derivatives) respect your privacy and would like to make it as transparent as possible for you as to why and how we process and store your data.

These data protection provisions describe which personal data we collect from you on this website and which rights you have (Art. 13, 14 GDPR).

If we do not provide a link to other data protection provisions, these provisions apply if you use the uptain website, the uptain customer backend or other services.

By using the Services, you agree to the terms and conditions of this Privacy Policy.

If you do not agree with the terms and conditions or other agreements relating to our Services, you should refrain from using the Services.

Which data do we collect

Data provided by you

The type of information we collect from you depends on how you use our services. The following table lists scenarios that clearly indicate what information we collect from you.

Account data To be able to use the customer backend, you need an individual account in our system. For this purpose, we store your e-mail address and your password.
Application data When you send us an application, we save your application securely.

 

Automatically collected data

We automatically collect data when you use our services.

Type Description
System data We collect technical data about your computer, browser or device with which you access our services. These include your IP address (will be anonymized), device type, type and version of the operating system and browser.
Usage data We record the behavior of users on our services (e.g. the uptain website and the customer backend). We store the pages called up, clicks and the date and time of access. However, this data is not combined with your personal data (e-mail address).
Geodata We determine your approximate geographical location on the basis of your IP address.

The listed data is collected via tracking technologies and server log files. For more information, see the “Cookie and Data Collection Tools” section. The system and usage information is not linked to your account information.

How do we obtain the information from you?

Cookie and data collection tools

We use service providers acting on our behalf, such as Google Analytics, to collect information, and we use data collection tools such as cookies and local storage (further: “cookies”).

Cookies

Cookies are small pieces of information that web pages send to your device to uniquely identify your browser. Cookies do not damage your computer and do not contain viruses. Cookies are used to make our website more user-friendly, effective and secure.

Most of the cookies we use are so-called “session cookies”. They are automatically deleted at the end of your visit. Other cookies remain stored on your terminal until you delete them. These cookies enable us to recognize your browser during your next visit.

You can set your browser so that you are informed about the setting of cookies and only allow cookies in individual cases, accept cookies for certain cases or generally exclude them and activate the automatic deletion of cookies when closing the browser. If cookies are deactivated, the functionality of this website may be restricted.

Contact form

If you use our contact form, you voluntarily give us your data for the purpose of requesting information or support from us. The entered data will be stored by us for the purpose of processing. For internal communication, we use the communication tool Slack. Slack Technologies Limited is strictly bound by an ADV.

To ensure that the email addresses entered in contact forms are also assigned to you, an automatically generated opt-in email is sent. A link in the email will allow you to confirm that you have the email address.

How we process your data

We internally use the tools Google Drive of Google Inc., Slack of Slack Technologies and Pipedrive of Pipedrive Inc. All tools and their providers work on our behalf. There are current contracts for order data processing.

Data that you send us by e-mail or via our website will be communicated internally within the company via Slack. Communication data is also stored in the Pipedrive CRM system so that you only ever receive the information that is relevant to you. In this way, we can guarantee the best possible support for you.

To whom we pass on your data

Your data will not be passed on to third parties unless we are legally obliged to do so. Insofar as external service providers come into contact with your personal data, we have ensured through legal, technical and organizational measures as well as through regular checks that the provisions of the data protection laws are complied with.

Security

We protect your personal data from unauthorized access, use or publication. We ensure that the information we collect is kept in a controlled and secure environment where unauthorized access and disclosure is prevented. Our employees are committed to secrecy and data secrecy. In addition, we have contracts with all service providers (e.g. website operators) for order data processing.

We would like to point out that data transmission over the Internet (e.g. communication by e-mail) can be subject to security vulnerabilities. Complete protection of the data against access by third parties is not possible. If you believe that your password or account is at risk, you should change it immediately.

SSL encryption

This site uses SSL encryption for security reasons and to protect the transmission of confidential content, such as requests you send to us as a site operator. You can recognize an encrypted connection by the fact that the address line of the browser changes from “http://” to “https://” and by the lock symbol in your browser line. If SSL encryption is activated, the data you transmit to us cannot be read by third parties.

Customer login

Access to your customer account is only possible after entering your personal access data. The uptain login area is SSL-encrypted. Your access data such as passwords are MD5 encrypted. You should always treat your access information confidentially and use the logout function after use.

According to Par. 15 – 21 GDPR you have the following rights at all times. Should you have any further questions, please do not hesitate to contact us.

Data protection settings

You can decide at any time to no longer providing certain data for collection. As a result, you may not be able to use certain features of the Services.

 

Right to information, deletion, blocking

The GDPR grants you as a user of the site far-reaching rights over the right of objection (see data protection settings):

Tools used

The following tools are integrated into the uptain pages for the creation and collection of data. We would like to point out that for all tools, if necessary, contracts for order data processing have been concluded.

Google Analytics                

This website uses functions of the web analysis service Google Analytics. The provider is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland.

Google Analytics uses so-called “cookies”. These are text files that are stored on your computer and enable an analysis of your use of the website. The information generated by the cookie about your use of the website will generally be transmitted to and stored by Google on servers in the United States.

IP Anonymization

We have activated the IP anonymization function on this website. This will cause Google to shorten your IP address within member states of the European Union or other signatory states to the Agreement on the European Economic Area before it is transmitted to the United States. Only in exceptional cases is the full IP address transmitted to a Google server in the USA and shortened there. On behalf of the operator of this website, Google will use this information to evaluate your use of the website, to compile reports on website activity and to provide other services relating to website activity and internet usage to the website operator. Order data processing

We have concluded a contract with Google for order data processing and fully implement the strict requirements of the German data protection authorities when using Google Analytics.

Our website uses Bing Ads technology to collect and store data from which user profiles are created using pseudonyms. This is a service of Microsoft Corporation, One Microsoft Way, Redmond, WA 98052-6399, USA. This service enables us to track the activities of users on our Web site when they arrive at our Web site through ads from Bing Ads. If you enter our website via such an ad, a cookie is placed on your computer. A Bing UET tag is integrated into our website. This is a code that is used in conjunction with the cookie to store some non-personal information about your use of the site. To improve the interaction with our visitors we use a Java-Script Plugin of uptain GmbH (“uptain-Plugin). This allows us to analyze your use of the website and to improve the way we address our customers (e.g. through a dialogue window). For this purpose we collect information about your usage behavior, i.e. movement of the cursor, length of stay, links clicked on and any information provided. The legal basis for the processing is our legitimate interest in direct marketing and the provision of our website. The uptain GmbH is strictly bound to our instructions. The information collected will not be passed on to third parties unless we are legally obliged to do so. Insofar as the information collected by the uptain plug-in contains personal data, this will be deleted immediately after your visit to our website.

Google Optimize

Our website uses Google Optimize, a Web analytics and optimization service provided by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. Google Optimize enables us to present new functions and content on our website to just a percentage of our users and record the changing use of our website. In turn, this allows us to evaluate which version best reflects the preferences and expectations of visitors to our website.

Outbrain

On parts of our website we use the technology of the provider Outbrain UK Ltd. with which our users are referred to further contents on websites of third parties which may be interesting for them. The further reading recommendations integrated by Outbrain, e.g. below an article, are determined on the basis of the previous content read by the user. Outbrain uses cookies, which are stored on the user’s computer/device, to display this additional content that is of interest to the user. The content displayed in the Outbrain widget is automatically controlled and delivered by Outbrain in terms of content and technology.

The display of reading recommendations by Outbrain by means of cookies is purely pseudonymous and users’ personal data is not stored. The data collected by Outbrain is Device source, browser type and the user’s anonymised IP address. To make the IP address anonymous, the last octet of the IP address is removed to ensure full anonymity.

Quora

We use services of the Quora service. Quora is operated by Quora, Inc., 650 Castro Street, Suite 450, Mountain View, CA 94041 (“Quora”). Quora enables us to use target-group based advertising, re-targeting and conversion measurements for online advertising through the so-called visitor interaction pixel. In doing so, offers for specific target groups are played out based on a selection of general criteria, such as demographic characteristics, regions or interests. Quora also allows us to target ads based on your previous page views. For example, if you are interested in certain services, information, or offers on our site, you may be shown ads and references to our offerings and content. Only general and technical information about pages viewed is evaluated.
